On behalf of myself, my child or legal guardian who participates in any activity, in any manner, at Pedro’s Sports or Sanchos Cantina, which includes pickle ball, cornhole, dodgeball, darts, ping pong, soccer or any other sport or activity allowed by Pedro’s Sports and Sanchos Cantina (any “Activity”), the undersigned, on my own behalf and on behalf of my child or legal guardian, my personal heirs, assigns, personal representatives or family members, hereby:

1. FULLY ACKNOWLEDGE, agree, warrant and represent, that I completely understand the nature(s) of the Activity and that I, my child or legal guardian, is qualified, in good physical condition and health to participate the Activity. I also agree and confirm that if at any time my, my child’s or my legal guardian’s capacity to continue participating in the Activity is in question, I shall stop, or cause my child or guardian to stop, participating in the Activity.
2. COMPLETELY UNDERSTAND THAT (i) PARTICIPATING IN THE ACTIVITY INVOLVES AND COULD CAUSE RISKS AND DANGERS OF SERIOUS PHYSICAL INJURY, TO INCLUDE PERMANENT PARTIAL OR TOTAL DISABILITY AND DEATH (hereinafter “Risks”); (ii) such Risks and dangers may result from, and/or be caused by the actions, or inactions or judgments of myself, my child or my guardian, the actions or participation of other individuals participating in the Activity, the weather or conditions in which the Activity occurs, or the carelessness or negligence of the “Released Parties” listed herein; (iii) other Risks and losses, whether economic, social, physical or psychological that are not presently known or foreseeable by me, my child or my guardian; and I hereby ACKNOWLEDGE, ASSUME AND ACCEPT ALL SUCH RISKS AND RESPONSIBILITY FOR DAMAGES, LOSSES, INJURIES, COSTS OR EXPENSES that I, my child or my legal guardian may incur or could incur as a result of my, his or her participation in the Activity.
3. FULLY RELEASE, WAIVE, DISCHARGE, PROMISE AND AGREE NOT TO SUE OR PURSUE ANY LEGAL CLAIM AGAINST PEDRO’S SPORTS, LLC, SANCHOS CANTINA, LLC and any and all of their related entities, their managers, administrators, directors, employees, agents, officers, members, shareholders, guests, invitees, volunteers, sponsors, other participants, including any and all individuals or entities that own the property where the Activity occurs (which shall all be considered “Released Parties”) FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITY, DAMAGES, LOSSES OR HARM TO ME, MY CHILD, AND MY LEGAL GUARDIAN WHICH ARE CAUSED OR ALLEGED TO BE CAUSED IN ANY WAY BY THE NEGLIGENT ACTS OR OMISSIONS OF THE RELEASED PARTIES OR FOR ANY OTHER REASON, TO INCLUDE ACTIONS ATTEMPTING TO ASSIST, AID, RESCUE ANY PARTY, REGARDLESS OF WHETHER ANY SUCH LIABILITY WOULD OR COULD OTHERWISE RESULT IN LOSS OR DAMAGES TO MYSELF, MY CHILD OR MY LEGAL GUARDIAN, OR THEIR HEIRS, FAMILY MEMBERS OR PERSONAL REPRESENTATIVES, AND I ALSO AGREE THAT DESPITE THIS WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, IF I OR ANY PARTY ON MY BEHALF MAKES ANY CLAIM AGAINST ANY OF THE RELEASED PARTIES, I AGREE TO SAVE, INDEMNIFY AND HOLD HARMLESS EACH AND ALL OF THE RELEASED PARTIES from and against any costs, expenses, litigation costs, attorneys’ fees, charges, damages, losses or any other sums that could result from such a claim or claims.
4. PERSONAL PERMISSION. I hereby provide to Pedro’s Sports, LLC and Sanchos Cantina, LLC, and their agents and designated parties, the permission to use, publicize, distribute, without any obligation or limitations, my photograph, name, image, voice and/or words for any purposes in relation to the Activity, including for marketing and informational purposes.
5. I HEREBY AGREE THAT THIS WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT WILL CONTINUE IN FORCE AS OF THE DATE OF MY SIGNATURE UNTIL I DELIVER A REVOCATION OF SUCH IN WRITING TO PEDRO’S SPORTS, LLC AND SANCHOS CANTINA, LLC.
